San Diego – Californians are one step closer to ending the “Anchor Baby” births by illegals throughout the state. In an effort to close ever-expanding social service programs the California Taxpayer Protection Act of 2010, Initiative 09-0010 has begun the signature process.
The Attorney General of California released the last bit of paperwork required to get the “birth tourism” legislation moving forward. Petitioners must now collect approximately 450,000 California registered voter signatures.
At a press conference in front of the City Hall Administration building, Ted Hilton- author of the bill, Bill Morrow-retired California State Senator, Peter Nunez-former United States Attorney and Assistant Secretary of the Treasury for Enforcement joined together to inform the residents of California to take the immigration issue into their own hands.
This bill is for “real world citizens,” Morrow said. “The people of California have an opportunity to curb the illegal immigration. Many in California may not have seen the grass lately, but we’ve been seeding our roots.”
According to the Attorney General for the state of California, who prepares the title and summary, the state would deny birth certificates to children born to undocumented parents unless the mother provides a fingerprint and other information to be given to the federal authorities.
Finally, the initiative eliminates benefits for children in child-only CalWORKS cases which are not mandated by federal law.
For those who want reassurance, the public benefit restrictions in this initiative have already passed and are on the books in five states, Colorado, Georgia, Idaho, Oklahoma and Arizona.
The California ballot initiative is closely worded to the law on the books in Oklahoma, says Hilton.
Many in California believe the federal government has dropped the immigration ball over the last 40 years. “In Washington D.C. they have a few nicknames; reform is code word for amnesty,” Nunez explained.
He goes on to say that if Americans allow another amnesty wave to come ashore a new wave of immigrants will head to America – this time the number could be 40 million.
Again Nunez says, “It’s time for the states residents to take care of the illegal immigration problem, the federal, state and local governments have failed.”
As far as immigration containment issues there are three areas that need to be addressed; Border security, workforce enforcement and doling out of public benefits. This ballot initiative addresses the latter, benefits.
The crux of this issue is the “birth tourism.” The state currently pays $400 million per year in ‘normal childbirth,’ according to the state of California Department Health’s latest records. “This doesn’t include the cost of premature births which the Center for Disease Control estimates as 12 percent of all births. The costs to taxpayers for these births and those born with disabilities are over $1 billion more annually,” Hilton said.
According to California State Attorney General office, the initiative would save the taxpayers around $1 billion annually from eliminating the child-only CalWORKS program. Morrow believes the number is much higher. “If you add the costs for ending public benefits, the state will save much more than $1 billion per year.”
Another concerned group that has come out and supports the 2010 ballot initiative are African-Americans.
Ted Hayes who recently ran for congress against Maxine Waters in Los Angeles said, “American black men will stop the birth tourism problem connected to the 14th Amendment.”
“That law was meant for West African slaves, not Latinos crossing the border illegally,” Hayes firmly stated. “The Latinos are taking money from the sweat from our backs; we intend to take it back.”
Nunez concurs, “The 14th Amendment was a way for this country to overcome slavery. Our current national policy doesn’t even allow diplomats in this country to gain citizenship through birth.”
Hayes admits it’s time African-Americans to start fighting for their state and country. “The Latinos want to make this about race. I’ll make this about race. The sponsors of this bill are not racists, they’re Americans and we stand with them.”

Backed up by fact, Hilton notes in 1987 California’s teenage birth rate was below the national average. One short year later, pre-natal care commenced for illegal aliens. “Four years later that caused the state’s teenage birth rate to grow to twice the national average and the highest of any state,” says Hilton.
According to the State of California, Department of Public Health’s latest birth records show there were 562,157 live births. A staggering 293,276 were born to a mother of Hispanic background.

I think that the democrats making this state a safe haven for illegals to come get free medical care, free welfare money, and a bunch of other social programs, all while stealing our jobs, IS WHAT CAUSED THE MESS WE ARE IN here in California.
The tax these people have on our system is unquestionably high. California is about to release thousands of prisoners because we cant afford to feed and house them, WHY DO THAT WHEN WE CAN JUST STOP FEEDING AND HOUSING THE MILLIONS OF ILLEGALS!
We can get the signatures, we can get the votes to pass it. Then the ACLU will take it to court as unconstitutional and it will not go into effect just as the 1994 bill.
Most Of California’s Prop. 187 Ruled Unconstitutional
LOS ANGELES (AllPolitics, March 19) — A U.S. District Court judge has declared most of California’s Proposition 187 unconstitutional.
Approved by voters in 1994, the proposition would have denied health care, education and welfare benefits to illegal immigrants. Almost immediately, Judge Mariana Pfaelzer granted its opponents’ request for a restraining order, which prevented it from taking effect.
In her final ruling, Pfaelzer rejected California’s attempt to regulate immigration, which she said is the federal government’s responsibility.
Judge Pfaelzer’s ruling strikes down portions of the initiative that would have required law enforcement, teachers, social service and health care workers to verify a person’s immigration status. Under Proposition 187, they would have had to report illegals to authorities and to deny them social service, health care and education benefits.
The American Civil Liberties Union’s Southern California chapter was one of the five groups which sued to stop Proposition 187. In a statement, ACLU spokesman Mark Rosenbaum said Pfaelzer correctly denied California’s attempt to regulate immigration.
“[It is] not a matter for individual states to attempt to formulate their own rules and procedures,” Rosenbaum said. “School teachers and doctors are not substitutes for INS agents.”
But California Gov. Pete Wilson, who supports Proposition 187, vowed to appeal, “so that the will of the people can be upheld.”
The appeal was dropped by the next Govenor

If they approved this initiative, they are killing the real soul of America. They must be reported to those who care about America Future to stop them.

So much for all of those bleeding hearts claiming that illegal immigrants help make the economy better and don’t create a drain on it. California is bankrupt now.
I hope there is some way to put a grandfather clause into the bill so that it can be retroactive and take away some of the birth certificates which were given out already to illegal immigrants’ babies unless those conditions are met.

AZ gives out a foreign birth, birth certificate and they are not eligible for State benefits. It has helped.
The 14th is grossly misused by the Fed’s and needs to be retroactive.
The Senators who drafted the 14th amendment stated quite clearly in debates what they intended when wrote the phrase “under the jurisdiction of” and it was never intended to give birthright citizenship to foreigners or aliens.
Let’s hope the other US states do the exact same thing, if they haven’t already!
I lived in Ca. and i felt like i was the alien. Everyone wants a chance. that’s why Americans are here now.They took over there world not the other way around. will me i guess we just wanted to ride the big boat. but the only thing that gets me is if i need papers to work so should anyone else. they can’t work unless we let them so who has the job that can employ them. I f they can’t work they will go home!

Hispanics aren’t the only illegal immigrants. When they say that, it sounds like it IS about race. Ted Hayes is hateful of Hispanics. Why don’t all you supporters of the Act just admit your dislike of Hispanics. I don’t understand how a person can hate another person because of their physical traits. Serious? We’re all human. Like YOU go to college to work the fields. ALL humans deserve a chance.
Well you don’t you really need a birth certificate I suppose. The children certainly are American citizens anyway. I guess you might need a birth certificate for some paperwork, like perhaps enrolling in schools and that sort of thing. I doubt that any state would allow a child to not attend though because of no birth certificate. Most truancy laws are pretty strict. The first time I ever recall needing to produce a birth certificate was when I wanted play football in high school and had to prove I was between the age of 13 – 19. The second time was when I applied for my passport some 12 years later. Other than that, I’m not entirely certain of the practical consequences of not having a birth certificate. As long as the hospital keeps medical records, which by law they are required to do, the children would have no problem proving citizenship at any time they felt the need.
