Why are some illegal aliens allowed to marry and get citizenship without leaving?

Illegal aliens who overstay a Visa can get their papers through marriage while staying here.

But the people who cross the border without inspection have to leave the country.

Why the double standard? Shouldn’t Visa overstayers be sent back the same?

    Its not really a double standard its a matter of getting caught if you over stay your visa and Immigration finds out you will be deported it goes the same for people crossing illegally if they get caught they get deported for both if they get married with a US citizen they both can get their green cards

    an illegal is a person who enters without inspection …and deemed correctly to be an illegal

    A visa overstayer entered legally with inspection… and deemed corectly to be an overstayer

    the method of entry is the deciding factor congress decided ….

    Well, it’s not really a double standard. The visa guy comes in legally, the river-swimmer comes in illegally.

    It’s called LOOPHOLE, and Immigration law is full of them. Yes, it’s stupid, I totally agree.

    both are illegal aliens, and some need to read a dictionary on the definition of an illegal alien. Neither should be allowed to adjust status, but since the ones who have came on visa’s have already had their background checks and immunizations according to the law. illegals who come across the border have had none of these.

    Illegal alien:

    Definition: A foreign national who has entered the United States without legal permission, or who entered the U.S. legally but has since fallen out of status. An illegal alien is deportable if apprehended.

    I do not see why illegal should not be allow to get married.

    Visa over stayers & ewi’s ( entered without inspection) could fix their status if they marry a US citizen. Or some family members are USC. USC needs to prove extreme hardship if allien qualify for a waiver.

    This is the same if someone comes into your home without being invited. It is breaking and entering. (illegal)
    Someone is invited to your home, then later won’t leave. Trespassing. (also illegal)

    Both illegal but Not the same! Overstaying your welcome is not the same as breaking in.

    none should be allowed to marry and they should arrest each American who attempts to marry an illegal. One came legally and then broke the law, the other came here breaking laws from the start. both are criminals and should be deported.

    There is really no double standard. Because they have a sponsor that will be responsible for them.
